DHS Sets $5,300 Fee Starting Oct. 16, 2026

TITLE: DHS Sets $5,300 Fee Starting Oct. 16, 2026

WHAT HAPPENED: The Department of Homeland Security (DHS) announced inflation-adjusted fees for two immigration enforcement fees. Starting October 16, 2026, DHS will begin charging the new amount of $5,300.

WHO IT AFFECTS: Only two groups: (1) noncitizens who were ordered removed “in absentia” — meaning a judge ordered them removed while they were not at the hearing — and are later arrested; and (2) noncitizens who are “inadmissible” — not allowed to enter the U.S. — and are caught between official ports of entry (not at an official checkpoint).

WHAT TO DO NOW: Check if either situation applies to you. If you are not in these two groups, this notice likely does not change your fees. If you think it may apply to you, talk to an immigration attorney before October 16, 2026. The source does not list a waiver or payment process, so ask an attorney about your case.
